Terms of Use

These Terms of Use apply to the public Film Grain Brain website, its content, support paths, and software products sold by Film Grain Brain LLC when a product page or checkout does not provide more specific terms.

Product-specific pages, app terms, license files, checkout terms, and written order terms may add requirements. If a specific product or order term conflicts with these terms, the specific term controls for that product or order.

Use the site lawfully and do not interfere with its operation, bypass access controls, impersonate another person, submit malicious or misleading material, probe systems without permission, or use automated collection in a way that burdens or copies the site beyond ordinary linking and indexing.

The site does not currently require a public customer account. If a product or service uses an account, customer portal, or download history, the applicable product or account terms will explain the additional requirements.

Film Grain Brain LLC and its licensors retain rights in the site, brand, software, copy, design, and original media except where another owner is identified. See the Copyright and DMCA page for reuse and notice information.

You keep ownership of the information and material you send through a contact or support form. You give the studio permission to receive, store, review, and use that material only as needed to respond, provide support, protect the service, or comply with law. Do not send confidential material unless the studio has agreed to receive it.

Unless a product page or product license says otherwise, a purchase gives you a personal, non-exclusive, non-transferable license to install and use the software on devices you own or control for the use allowed by the product page.

You may not resell, redistribute, sublicense, rent, lease, publish, extract, reverse-engineer, decompile, or attempt to obtain source code or protected assets except where applicable law gives you a right that cannot be limited. You may not remove notices or use the software to build a competing distribution of the product.

You are responsible for checking operating-system, hardware, host-application, permission, and compatibility requirements before purchase or installation. A supported configuration can change as Apple, host applications, or other dependencies change.

Updates may change features, requirements, or supported systems. Support is provided through the contact path described on the product page or at contact@filmgrainbrain.com. The studio does not promise a particular response time unless a product or support agreement says so.

The public store catalog is available for browsing, but paid checkout is currently unavailable. Viewing a catalog page does not place an order, create a license, or promise delivery.

When a product is offered for purchase, the checkout page will state the price, taxes, delivery method, requirements, applicable license, and any provider terms before payment. A hosted payment provider may process payment, fraud checks, receipts, tax, file delivery, licensing, and customer-portal functions. The provider’s buyer terms and privacy notice may also apply to that transaction.

Film Grain Brain offers a 14-day refund path for eligible digital software purchases unless the product page or checkout states a different period. See the Refund Policy for the request process. Product pages, checkout terms, and applicable law may provide additional rights or a different process.

Nothing in these terms removes a consumer right that cannot legally be waived. If a product includes a subscription, renewal, cancellation, or unused-term rule, the checkout and product terms will state it before purchase.

The site may link to or rely on third-party services for hosting, analytics, email, payment, checkout, file delivery, customer support, or external previews. Those services have their own terms and privacy notices. Film Grain Brain is not responsible for a third party’s independent service, outage, content, or policy, except where law requires otherwise.

To the fullest extent permitted by law, the site and software are provided as is and as available, without a promise that every page, service, or product will be uninterrupted, error-free, or compatible with every system. Mandatory warranties and consumer protections are not excluded where they cannot be excluded.

To the fullest extent permitted by law, Film Grain Brain LLC is not liable for indirect, incidental, special, consequential, or punitive damages arising from use of the site or software. Total liability for a paid product is limited to the amount paid for that product, subject to any limit that law does not allow the parties to impose.

The studio may suspend a route, download, account, or license when needed to address abuse, security, non-payment, a legal requirement, or a material breach. A suspension does not remove rights that already apply under law or a written refund decision.

These terms may be updated as the site, products, providers, or law changes. The page date will change when a material revision is published. If a court finds one provision unenforceable, the remaining provisions should continue to operate to the extent allowed by law.

These terms are governed by the laws of the State of Ohio, USA, without choosing a different jurisdiction’s conflict rules, subject to mandatory consumer protections and applicable law. Questions should go to contact@filmgrainbrain.com.
